Terms of Service

1. Agreement

By creating an account or using TrueMails (website, web app, desktop app, API, or worker), you agree to these Terms and our Privacy Policy. If you use TrueMails on behalf of an organization, you represent that you have authority to bind that organization.

2. The service

TrueMails is software for creating and sending permission-based email campaigns. Features include contacts, lists, templates, campaigns, multi-SMTP configuration, suppression, usage quotas, and subscription billing. We may improve or change features with reasonable notice when changes are material.

3. Accounts & security

Provide accurate registration information and keep credentials confidential.
You are responsible for activity under your account.
Standard Edition is designed for a single-seat licensee subject to plan device limits.
App Admin may suspend accounts that violate these Terms or applicable law.

4. Subscriptions & fees

Paid plans (e.g. Starter, Pro, Business) include monthly, 6-month, and yearly billing options as shown on the Pricing page.
Limits on emails/month, contacts, and devices are enforced according to the active plan.
A short grace period may apply after expiry; sending may be paused when subscription or quota is exhausted.
Prices are typically listed in INR; taxes may apply as required by law.
Payments are processed by third-party providers (e.g. Cashfree). Their terms also apply to the payment step.

5. Acceptable use

You may not use TrueMails to:

Send unsolicited bulk email (spam) or purchased/scraped lists without a lawful basis.
Phish, impersonate others, distribute malware, or promote illegal content.
Bypass subscription, device, or quota controls.
Attack, overload, or reverse engineer the service beyond permitted interoperability.

You must honor unsubscribe requests and maintain accurate suppression where required by law (e.g. CAN-SPAM, CASL, GDPR where applicable).

6. Your content

You retain ownership of contacts, templates, and campaign content. You grant us a limited license to host and process that content solely to operate the service. You represent that you have the rights needed to use that content and to message recipients.

7. Third-party services

SMTP providers, DNS, and payment gateways are third parties. Deliverability depends on your domain authentication (SPF/DKIM/DMARC), list quality, and provider policies. We are not responsible for third-party outages or inbox placement decisions by mailbox providers.

8. Intellectual property

TrueMails software, branding, and documentation are owned by us or our licensors. These Terms do not transfer ownership. You may not copy or resell the product except as expressly allowed.

9. Disclaimer

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. We do not guarantee uninterrupted service or specific open/click rates.

10. Limitation of liability

To the maximum extent permitted by law, our aggregate liability arising out of these Terms or the service is limited to the fees you paid to us for the service in the three (3) months before the claim. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost data.

11. Termination

You may stop using the service at any time. We may suspend or terminate access for violations of these Terms, non-payment, or risk to the platform. Provisions that should survive (fees owed, liability limits, IP) will survive termination.

12. Governing law

These Terms are governed by the laws of India, without regard to conflict-of-law rules, unless mandatory local consumer law provides otherwise. Courts in India shall have exclusive jurisdiction, subject to applicable consumer protections.
